The court ordered the Honored Artist of Tatarstan, singer Dina Garipova and Channel One JSC to pay compensation for copyright infringement to the son of the legendary Russian composer, Honored Artist of Russia Mark Minkov. This is reported by the portal "Gazeta.<url>" with reference to the data of the Rusprofile service.
Initially, Andrei Minkov demanded compensation for the illegal use of the songs "They do not renounce loving" and "You are in the world", the rights to which he inherited, in the amount of 1.6 million rubles, including 600 thousand rubles from Garipova.
In court it turned out that the singer illegally performed the songs of Minkov Sr. as part of the show "The Voice", as well as the programs "New Year's Eve on Channel One" and "Tonight", the videos of which were published on the official website of Channel One. Videos were also available on Garipova's VKontakte page.
"The offenses committed by the defendants are not one-time, but systemic, lasting in nature, since the placement of a complex object (a television program or its fragments) on the Internet implies that any person can get acquainted with it <> during the entire period, starting from the moment the TV program is posted on the Internet until the defendants themselves remove it from there," the decision of the Moscow Arbitration Court says.
The first channel was ordered to pay 1 million rubles, the amount of compensation from Garipova was reduced tenfold — up to 60 thousand rubles, since the court took into account the degree of guilt of the singer, the lack of evidence of probable damages and the proportionality of compensation to the consequences of the violation. The decision has not yet entered into force.
The publication notes that in January of this year, Andrei Minkov sued Channel One for 690 thousand rubles for the illegal use of the song "You know, it will still be" in the program "Anniversary Evening of Yuri Nikolaev."
As EADaily reported, earlier the Moscow City Court approved a settlement agreement between the Soviet and Russian composer, People's Artist of Russia Alexei Rybnikov and the Apple Music platform on a lawsuit for the protection of rights to works.
Rybnikov filed a lawsuit against Apple Music in court to protect the exclusive rights to 247 songs. The court took interim measures, prohibiting the platform from distributing his works, including songs from the movie "Pinocchio".
