Customs questioned the price at which Gazprom Neftekhim Salavat sold fertilizers to the UAE and recalculated the cost of the cargo. The plant could not challenge the decision.
"Gazprom Neftekhim Salavat was convicted of exporting fertilizers at below-market prices. The largest petrochemical plant in the south of Bashkiria sold products abroad at a discount of more than 40%,"RBC reports with reference to customs.
The proceedings relate to a deal that was concluded in 2022. Gazprom Neftekhim Salavat, which is the largest petrochemical complex in the south of Bashkiria, sold 4.6 thousand tons of carbamide to Quest Group DMCC at a price of $ 151.25 per ton, while the average price for fertilizers was then $ 256.25.
"The Volga electronic customs in 2024 checked the deliveries and doubted the validity of the price. The agency calculated the new customs value of the goods — 108.6 million rubles. Gazprom Neftekhim Salavat disagreed with these conclusions and challenged the customs decision in court," the agency continues.
However, on December 25 of this year, the Arbitration Court of the Nizhny Novgorod region refused to satisfy the requirements.
"Gazprom Neftekhim Salavat LLC did not provide evidence testifying to the reliability of the declared customs value of the exported goods, and also did not eliminate the doubts that the customs authority had about the reliability of the declared customs value. The declarant has not eliminated the sign of unreliability of the declared information about the customs value, expressed in the identification by the customs authority of a lower price of the declared goods compared to the price of goods meeting the criteria of identity and homogeneity,"RBC cites the court ruling.
Since the decision has not entered into force, the parties can still appeal it.
