The Court of Appeal of the Krasnodar Regional Court granted the complaint of the widow of singer Yuri Shatunov Svetlana against the decision of the Khostinsky district court of Sochi of 2007 to establish the authorship of the songs "Tender May" for producer Andrei Razin, who is currently arrested in absentia on charges of fraud.
As the lawyers of the singer's widow's family told TASS, the court decision comes into force immediately.
"The court agreed with the appellant's argument that Razin's position is more than contradictory, given that during the court session of the Khostinsky District Court of Sochi in 2005, the defendant [Razin] claimed that the author of the disputed works was Sergey Kuznetsov, whereas in 2007 Razin "remembered" that it was he is the author of the works," said lawyer Oleg Sitnikov.
"The court has just found our arguments in the appeal to be justified that the case should have been considered in the order of claim proceedings, and making a decision in the order of special proceedings on the recognition of a fact of legal significance is gross procedural evidence. The court's decision comes into force immediately," the defender said.
According to the second lawyer Assel Mukhtarova-Kazarnovskaya, the court did not agree with the arguments of Razin's representative that his authorship is confirmed by handwritten sheet music.
"Despite the fact that during the consideration of our complaint, Razin's representatives had previously attached sheet music and a statement about his musical education, we were faced with gross musical errors [by] the former music producer of the band," said the defender of the Shatunova family.
On December 4, 2025, the Khostinsky District Court of Sochi considered Razin's petition to resume and review the copyright protection case due to newly discovered circumstances. Earlier, Shatunov's widow and children filed a lawsuit against Razin, demanding that they recognize the exclusive rights to 23 songs, including such hits as "White Roses", "Gray Night" and "Pink Evening". The court satisfied the claims of Shatunov's family. Razin was unable to appeal to the Supreme Court of the Russian Federation the denial of the rights to the songs.
The newly discovered circumstances relate to Razin's statement on the establishment of the fact of authorship of musical works from 2007. Khostinsky district court recognized this fact. During the hearing in court on December 4, it was mentioned that the singer himself was not involved in the case. In addition, the court postponed consideration of Razin's petition in connection with the involvement of the Social Fund of Russia in the process and with the requirement for the representatives of the Shatunovs and Razin to establish the places of residence of their principals.
