The EU Court completely rejected the claim on the transit of Belaruskali's cargo through Lithuania

The Court of the European Union rejected all the demands of the Klaipeda port stevedoring company Bulk Cargo Terminal (BKT) on the lifting of sanctions for the transit of potash fertilizers Belaruskali. This is reported by the Lithuanian media.

"BKT sought to annul the decisions of the EU Council on restrictive measures that led to the suspension of the transit of Belaruskali fertilizers through the port of Klaipeda in Lithuania in February 2022. The European Court of Justice stated that some of the company's arguments could not be considered because the lawsuit... was filed in violation of the established deadlines. The Court added that it has no authority to oblige institutions The EU should change foreign policy decisions or adopt new legislation on the application of sanctions," the report says.

It is reported that the court rejected all the claims of the company and ordered BKT to cover not only its own legal costs, but also the costs incurred by the Council of the European Union.

Earlier, 10-11 million tons of Belaruskali fertilizers were loaded onto ships through the Klaipeda port. which owns 30% of the shares of Biriu kroviniu terminalas (BKT, "Bulk Cargo Terminal") in the Lithuanian seaport. In January 2022, the Lithuanian government invalidated the cargo transportation agreement between Lithuanian Railways and Belaruskali — since February 1 of the same year, the transportation of potash fertilizers through Lithuania has been stopped. The contract of the state-owned company Lithuanian Railways with BKT was terminated at the initiative of the Lithuanian side in 2023. In October of the same year Belaruskali initiated investment arbitration proceedings against Lithuania. The Belarusian fertilizer producer believes that the contract was terminated illegally and possibly in violation of the bilateral agreement on the promotion and protection of investments signed between Lithuania and Belarus in 1999, and demanded compensation for the damage caused.
